Former Humboldt Walmart Seized As Public Nuisance

On Monday, October 7, 2024, before the Honorable Clayburn Peeples in the Circuit Court of Gibson County at Humboldt Law Court, the Office of the District Attorney General of the 28th Judicial District, through General Frederick Agee, filed a Public Nuisance Petition on a property located at 2500 North Central Avenue in Humboldt, Tennessee.
This property (the former Walmart) is owned by defendant Brian Moss, who his facing multiple criminal charges including Possession of Schedule I, II, III, IV, and VI Controlled Substances with Intent to Sell/Deliver, Maintaining a Drug Location, Possession of Firearms during the Commission of a Dangerous Felony, and Possession of Drug Paraphernalia. These charges stem from two separate arrests, on July 25, 2023 and while released on bond, a subsequent arrest on September 25, 2024.
As part of these criminal charges, the West Tennessee Drug Task Force alleges that Moss has been illegally manufacturing and distributing drugs, including anabolic steroids, from this location.
The Public Nuisance Petition submits that it is necessary for the safety and well-being of the community to close and vacate the property, which includes Humboldt Fitness, and the adjoining warehouse located at 2500 North Central Avenue for five days, due to Moss’s continuous illegal activities at the property.
At the end of the five-day period, a hearing will be held for Judge Peeples to either extend the temporary injunction or lift it, dependent on proof and arguments submitted by the State and Moss, with Counsel if retained.
“Law enforcement has alleged that the Defendant continued to sell illegal drugs out of this property which is located on a main corridor in Humboldt. He has pending felony charges not only in Circuit Court but now new felony charges in General Sessions Court while released on bond. Therefore, it was imperative for our Office to petition the Court to intervene regarding this alleged ongoing criminal activity.” – Frederick H. Agee, District Attorney General.
Moss remains in the custody of the Gibson County Jail pending a preliminary hearing for his new charges, scheduled for Tuesday, October 29, 2024, in General Sessions Court.
The Public Nuisance Petition is being handled by Assistant District Attorney Holden Kirk, and his criminal cases are being prosecuted by Assistant District Attorney Nina Seiler.
